End User License Agreement

Terms of Service for Koda Remote

1. License Grant

By downloading Koda Remote from the Apple App Store, Maximilian Kallina ("Licensor") grants you ("User") a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application on devices you own or control, subject to the terms of this Agreement.

2. User Rights

By obtaining a license, you are entitled to:

  • Install and use the Application on Apple devices you personally own.
  • Use the Application for its intended purpose: controlling Kodi media centers.
  • Receive updates and patches as they are released.
  • Contact support for technical assistance.

3. Licensor Rights

The following rights remain exclusively with Maximilian Kallina:

  • Copyright: Full ownership of all source code, design, and architecture.
  • Trademark Rights: Exclusive rights to the "Koda Remote" name, logo, and associated marks.
  • Distribution Rights: Sole authority to distribute, license, or sublicense the Application.
  • Modification Rights: The right to update, modify, or discontinue the Application at any time.
  • Revocation Rights: The right to terminate this license upon violation of these terms.

4. Restrictions

You agree not to:

  • Decompile, reverse engineer, disassemble, or attempt to derive the source code.
  • Modify, adapt, translate, or create derivative works.
  • Redistribute, sell, rent, lease, or sublicense the Application.
  • Remove or alter any proprietary notices or labels.
  • Use the Application for any unlawful purpose.

5. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. THE LICENSOR DISCLAIMS ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF CONTENT

The Licensor does not warrant that the Application will be uninterrupted, error-free, or secure.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • The Licensor shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • The Licensor shall not be liable for any loss of data, profits, revenue, or business opportunities.
  • The Licensor's total liability shall not exceed the amount paid for the Application (€0.00).

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, the limitations above shall apply to the fullest extent permitted by law.

7. Termination

This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use and delete all copies of the Application.

8. Governing Law

This Agreement shall be governed by the laws of Austria, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Vienna, Austria.
